Thailand Divorce Agreements

 

A Thailand divorce agreement also known as a Divorce Settlement Agreement is a contract entered into by a divorcing couple who can agree on the important issues of a divorce, such as:

  1. Division of marital property
  2. Child custody
  3. Child support
  4. Alimony (maintenance)
  5. other issues such as, property managed on behalf of children, educational plans, payments of debts, change of surname, etc.

A divorce agreement can be used bosth in a consensual or uncontested divorce and in a court divorce. When used in a consensual or uncontested divorce, the agreement is registered with the Thai government concurrently with a consensual divorce registration.

In court proceedings for divorce in Thailand, if the parties can reach an agreement, the case will “settle” and the divorce agreement will be entered into the court judgment. If the parties cannot reach a divorce settlement agreement, the court will issue a judgment that will control the major issues in the case.
