Thailand Separation Agreement

A separation agreement is a formal agreement between spouses  who decide to no longer live together as a married couple, but are not yet ready for divorce. A separation agreement assists a married couple to manage their joint finances, and property along with the custody, expenses and care of their children in a cooperative plan.

Some jurisdictions provide a legal framework for enforcing a separation agreement. Thailand law however does not officially recognize separation agreements. A separation agreement is a private agreement between spouses in Thailand. Nevertheless, a separation agreement in Thailand may serve several important objectives as follows:

  1. A Thailand separation agreement usually states that spouses will reside separately. This provides evidence of separation of the spouses which is important for establishing a ground for divorce under Thai law.
  2. A separation agreement may provide a workable plan for spouses planning a divorce to deal with matters such as place of residence, child custody, maintenance, child support and use of marital property, and thereby reduce the risk of disputes.
  3. A separation agreement in Thailand may provide a non-binding precedent for the issues to be resolved in a subsequent divorce.
